Confidentiality provisions in settlement documents are one way that wrongdoers help to hide their conduct from further responsibility. But there are other problems with such confidentiality provisions that should also cause litigants to reject them. One such problem is that a confidentiality provision may give rise to negative tax consequences. In 2003 the U.S. Tax Court ruled that $80,000 of a $200,000 settlement for Eugene Amos was actually for confidentiality (rather than injuries) and was therefore taxable. Eugene Amos, Jr. v. Commissioner of Internal Revenue, U.S. Tax Court Docket No. 13391-01 (Dec 1, 2003). As a result of this decision, Mr. Amos was required to pay income taxes on $80,000 of the funds received from the wrongdoer (Dennis Rodman).

Explosion, Demolition & Blasting Accidents

Deadlines to File Explosion, Demolition & Blasting Accident Claims

The deadline for most explosion, demolition & blasting accident claims in Hawaii is two (2) years from the date of the injury. Hawaii Injury Lawyer | Attorney- Deadlines It should be noted, however, that there are exceptions to this rule- for example, claims against the City and County of Honolulu and the various other Counties must be filed with the appropriate agency within six (6) months of the date of the accident. In many explosion accident cases, the claim deadlines of other jurisdictions come into play and choice of law rules may shorten the deadlines to one year or another length of time. Whatever the deadlines may be, you must file your claims in court prior to the expiration of such deadlines, or your claims may be lost—regardless of their merit. To be wise it is recommended that you immediately contact an attorney after an explosion, demolition & blasting accident giving rise to injuries occurs. If you wish to do so now, please do not hesitate to contact us here at Hawaii Injury Lawyer | Attorney right now for a free evaluation of your case.

Explosion, Demolition & Blasting Accidents in Hawaii

Explosion, demolition & blasting accidents are very dangerous. Explosion, demolition & blasting accidents are likely to cause death and serious injury. Thus, there are special laws that regulate and precautions that are necessary whenever a person or business is dealing with explosive materials.

Types of explosion, demolition & blasting accidents which have been known to occur- and which may occur again- include, but are not limited to:

  • Accidents during the trucking, air freight or other delivery of explosive materials
  • Unexploded ordnance accidents
(Hawaii still has unexploded ordnance from WWII and training exercises)
  • Demolition and blasting cap accidents, esp. during sitework and excavation
  • Accidents involving the sale or storage of petroleum products and other explosive materials
  • Automobile gas tank design defects
  • Battery explosions
  • Fireworks accidents, esp around New Year's and the 4th of July
  • Pressurized consumer products, especially when heated in Hawaii's sun
  • Unguarded and unsafely stored or abandoned explosive materials

If an explosion accident injury occurs as a result of the negligence or fault of someone other than the employer of the victim, there probably will be a valid claim against the actual party at fault. If you or someone you love were seriously injured in an explosion accident, you may want to consult with an attorney to assist you with your situation.
